These Terms of Service ("Terms") are an agreement between you and Buy Me Tokens ("we", "us"), who run Buy Me Tokens at https://buymetokens.xyz (the "Service"). By using the Service, creating a page, or paying someone through a page, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
1. What the Service is (and isn't)
Buy Me Tokens lets people create a public page where others can choose to support them, framed around AI tokens. It shows the ways a page owner ("Creator") can be supported, such as a crypto wallet address, a link to a third-party payment provider, or free ways to help like a GitHub star. For USDC payments we provide a checkout that creates a payment request and then checks the public blockchain to confirm the payment arrived.
- We never hold, process, or transfer money or crypto. Payments go directly from the supporter's wallet or account to the Creator's. Our checkout only prepares the payment and reads the blockchain afterwards.
- "Tokens" is a metaphor. Supporters are sending money, not buying tokens or credits from us. We deliver no tokens, credits, goods, or services to supporters.
- We are not a bank, payment processor, money transmitter, exchange, broker, marketplace, or financial adviser, and nothing on the Service is financial, legal, or tax advice.
2. Who can use it
You must be at least 18 years old (or the age of majority where you live) and able to enter a binding agreement. You may not use the Service if you are barred from doing so by law, or if you are located in, or ordinarily resident in, a country or region subject to comprehensive sanctions, or on a sanctions list. We may block access from such places.
3. Accounts and page names
- You sign in with a Google or GitHub account. Keep that account secure. You are responsible for activity on your Buy Me Tokens account.
- Page names (usernames) are first come, first served, and may not be reserved words, misleading, or impersonate another person, brand, or project.
- A page name is a license to use, not ownership. We may reclaim or change a name that violates these Terms, infringes someone's rights, or has been abandoned.
- Only create a page for yourself or a project you are entitled to represent.
4. Your content and what you can't do
You keep ownership of what you post (your name, photo, bio, links, and addresses, together "Content"). You give us a worldwide, non-exclusive, royalty-free license to host, display, and distribute it as needed to run the Service, including in share cards and previews. You are responsible for your Content.
You agree not to:
- Add a wallet address, payment link, or account that is not yours or that you are not authorized to receive money through.
- Mislead people about who you are, what you are building, what supporters will receive, or where their money goes.
- Promise tokens, credits, returns, or perks that you don't deliver, or present support as an investment.
- Run scams, phishing, or fraud; link to malware; or use the Service to collect payments for illegal goods or services.
- Post content that is unlawful, defamatory, hateful, harassing, sexually explicit, or that infringes anyone's intellectual property or privacy.
- Interfere with, scrape at abusive volume, reverse engineer, or overload the Service, or evade limits or blocks.
- Use the Service in violation of any law, including sanctions, export, consumer protection, and money-laundering laws.
5. Supporting a Creator
- Supporting is voluntary. In our USDC checkout you choose the amount before you pay. On other payment methods, amounts shown on the page are suggestions and the final amount is chosen on that provider's site.
- A payment is shown as confirmed only after we see the right amount of USDC reach the Creator's wallet on the blockchain. Payments made through other providers or sent manually can't be confirmed by us.
- Your payment is a transaction between you and the Creator (and any payment provider involved). We are not a party to it, can't reverse or refund it, and can't promise the Creator will do anything in return.
- Refunds, chargebacks, and disputes are handled by the Creator and the payment provider, under their rules.
- Before you pay, check that the destination (wallet address, network, or website) is correct and trustworthy. We check the format of what Creators add, but we do not verify that a Creator controls a wallet or that a linked site is safe. Use Report if something looks wrong.
6. Crypto payments
If a Creator accepts crypto, such as USDC, transactions are irreversible. Sending to the wrong address or on the wrong network can permanently lose funds. Networks can be congested, fail, or change. Crypto may be restricted or illegal where you live. Only use it where it is lawful for you. We don't control any blockchain or wallet and are not responsible for losses from these risks.
7. Badges, buttons, and the embed script
You may use the badges, buttons, and embed script we provide (for example, /embed.js and the images under /badge) on your own sites and repositories to link to your own page. Don't alter them to mislead, don't imply we endorse you, and don't use them to link to something other than your page. They are provided as-is, and we may change or remove them.
8. Reports and enforcement
We may review, remove, hide, or edit Content, block payment destinations, and suspend or end accounts at any time if we think these Terms or the law have been broken, if someone reports a problem, or to protect people or the Service. We don't promise to monitor everything, and we aren't liable for Content we haven't reviewed. We may share information with authorities where the law requires or allows it.
9. Fees
The Service is currently free and we take no cut of payments, because we never handle them. Payment providers and networks may charge their own fees. We may introduce optional paid features in the future and will tell you before they apply to you.
10. Third-party services and links
The Service links to and relies on third parties (for example Google and GitHub for sign-in, Railway for hosting, Neon for our database, Resend for email, wallets, payment providers, and blockchains). They have their own terms and privacy practices, and we are not responsible for them, for their availability, or for content you find through them.
11. Taxes
Creators are solely responsible for any taxes on money they receive, and for any reporting or licensing their activity requires. Supporters are responsible for their own tax treatment of what they send.
12. Copyright and other complaints
If you believe Content on the Service infringes your rights, email us at hello@buymetokens.xyz with the page address, what is infringing, and your contact details. We will review it and may remove the Content.
13. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows. We don't guarantee that the Service will be uninterrupted, secure, or error-free, that any page is accurate or legitimate, or that any Creator will receive support or deliver anything.
14. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost funds, or lost data, arising from your use of the Service or from anything a Creator or supporter does. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim (currently nothing) or USD 100. Nothing in these Terms limits liability that can't be limited by law, such as for fraud or for death or personal injury caused by negligence, and some places don't allow certain limits, so parts of this section may not apply to you.
15. Indemnity
You agree to defend and reimburse us for claims, losses, and costs (including reasonable legal fees) arising from your Content, your use of the Service, or your breach of these Terms or the law, to the extent the law allows.
16. Ending things
You can stop using the Service at any time and ask us to delete your account (see the Privacy Policy). We can suspend or end your access at any time, especially for a breach of these Terms. Sections that by their nature should survive (for example content licenses already granted for cached copies, disclaimers, liability limits, indemnity, and governing law) survive termination.
17. Changes
We may update these Terms. If a change is significant, we will give notice on the site or by email. Using the Service after a change takes effect means you accept it. If you don't, stop using the Service.
18. Disputes
If something goes wrong, please contact us first at hello@buymetokens.xyz so we can try to resolve it informally. Nothing in these Terms takes away the consumer protections you have under the laws where you live.
19. General
These Terms and the Privacy Policy are the whole agreement between us about the Service. If a part is found unenforceable, the rest still applies. Our not enforcing something is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a business change.
